What are my rights after my employer terminates my contract?

Although the pandemic is beginning to recede, job losses continue to be a problem. As a result, many people have resigned, and many others have had their contracts terminated. In this week’s blog, we want to focus on those who have had their contract rescinded. In that situation, here are three things you should receive from your employer.

  • Final payment:

According to the law, an employer must pay you all the wages he owes you immediately after the contract has ended. Also, according to law 227.3, you must be paid for the vacation days that you did not use. This does not include the value of unused sick leave days. If your employer is slow to make these payments, he must pay you for each extra day it took him to pay you.

  • Notifications of any change in the employment relationship:

If your employer knows that the employment relationship is going to change, they must notify you immediately. This means that your employer must inform you of any change before it takes effect. If your employer does not notify you of this change, he is breaking the law, and you can proceed legally.

  • Access to unemployment programs:

This law requires that your employer terminate your contract correctly so that you can have access to the benefits that the government can give you. It is also their responsibility to explain to you which programs you may apply to. Your employer may be able to accomplish this simply by giving you a brochure that tells you what programs are available to you.

These benefits could be similar if you quit your job. The only thing that would change is the payment format; we will discuss this in more detail in another blog.
