Fundamental rights of an employee - Hernandez Law | Attorney Tatiana Hernandez for Workers’ Rights

Fundamental rights of an employee

We must always defend our most basic rights. Depending on the environment you are in, these rights may vary. This week, we want to share with you the rights that are absolutely necessary for your workplace. We hope this helps you have a much healthier work life.

The three fundamental rights of a worker are:

1. The right to know: Your workplace has an obligation to ensure that its employees have instructions and training to stay healthy and safe. This can be presented in the following ways:

  • Through an inspection of the workplace to determine possible risks involved. The worker has the right to know all the dangers.
  • By having a security protocol accompanied by a straightforward procedure. This must comply with what is requested by the government and the internal standards of the company.
  • By having a clear emergency protocol. This means that if there is an emergency, you will know what to do. Also, by having a first aid kit.
  • By having clear reports for incidents and investigation procedures.

2. The right to participate: This right is crucial because it allows employees to give their opinion on the security procedures that must be carried out during their working hours. Employees need to give their input on the safety of their workplace. If an employee wants to make a change and that change makes legal sense, the employer must do so.

3. The right to say no: This right is related to having the power to say no to any activity that could endanger your well-being and health without having repercussions such as losing your position.

These rights are necessary and indispensable for your workplace. If you need help, please contact us.
