Americans with Disabilities Act

The Americans with Disabilities Act was established with the purpose of protecting the rights of people with some type of disability in different areas of everyday life such as means of transportation, jobs, public places, among others. The aim is to ensure that this sector of the population has access to all these facilities and the same opportunities as any other person.

What the law says…

Title 1 of this law is in which everything related to employment is established, so it protects both employees and people who are looking for a job so that they do not suffer from discrimination at the time of employment. who are found as candidates and can be hired based on their professional talents and aptitudes regardless of their disability. In addition, it is also established that the questions that can be asked regarding the candidate’s disability are limited until the moment in which the position has been offered within the company.

Employers with more than 15 employees have to comply with this law and provide any type of comfort necessary for their employees to carry out their work activities, offering them the same opportunities and conditions as other workers. Likewise, these organizations are prohibited from firing someone who has acquired a disability after already working in the company or denying them any development opportunity for having one of these.

If you are involved in a case where you believe you have been treated unfairly because you have a disability, you may file a complaint with the U.S. Equal Employment Opportunity Commission within of a period of 180 days after you have suffered this type of discrimination or mistreatment. Although you can file the lawsuit yourself, it is recommended that you have the support of an employment law attorney to help you better understand the legal process you are facing and fight with you to get the compensation you deserve.
