Frequently Asked Questions About New California Labor Laws

This year has been a year full of changes for the working world, primarily due to the restructuring of the work system necessary to deal with the COVID-19 pandemic. Some laws were passed directly in response to the pandemic, others as a result. Here we answer some of your most frequently asked questions related to the new labor laws.

Which companies have to call the employees they had laid off?

The size of the company does not affect these types of situations, but the area where they work does. This regulation applies to hotels, airports, and workers in the service industry affected by the pandemic. This means that it does not matter if the company is small or the size of Amazon; employers must adhere to this law.

Can I use my paid sick days if I get COVID-19?

Yes, if you still have days available, you can be compensated for the days you had to stop working.

What does the paid sickness expansion mean in regards to family members?

This expansion means that if someone in your family suffered from COVID-19 and you need to help them, you could. But as we mentioned on a previous occasion, it could only be done if you have available paid sick days.

When am I going to get paid overtime?

When an employee works more than 12 hours a day, he must be compensated twice his hourly wage. The same happens if you work seven days in a row.

When should I receive a meal and/or rest break?

When you work less than three and a half hours a day, it is not mandatory for you to have scheduled breaks. However, according to California law, if you work more than three and a half hours, you should be given 10 minutes for each hour of work on your contract. In addition, if your work is more than 10 hours a day, you should receive two different meal times.

These are some of the most frequently asked questions we receive. It is vital that you stay informed of the changes coming to the labor laws and that you understand your rights.
