For what reasons can an employer be sued?

Are you having problems at your work? Do you need to know if this problem can be taken to court?

If you answered yes, this article would be of interest to you. We will share some of the reasons you could take legal action against your employer, which will help you stay informed and feel more comfortable asking that your rights be respected.

You must know that this type of process can take some time but that eventually, you will obtain the justice you need. When you file a case, it will take approximately six months to investigate it, and then you will have three months to go before a court. Here are some of the reasons an employee would like to file a court case against his employer:

  • Illegal termination of a contract:

According to California law, your contract can end at any time. However, termination is illegal when the following happens: you are fired for no reason, they say that your performance is not ideal, but they have no proof, when there was a verbal or written contract, right after a claim was made related to the workplace, when the dismissal occurred without following company policies, and especially, if it is based on a protected characteristic.

  • Payment reduction:

To proceed legally in this, it is important that you always take notes of the hours you worked and the hours you were paid. These laws are very strict at the federal and local levels, so it will be easy to make a claim if they are not being respected.

  • Personal injuries:

In most cases, if an employee is injured at work, he or she will be able to claim compensation for the injury. If not, it is necessary to proceed legally. Your employer should provide you with insurance to cover these types of expenses. In the case of injuries, you need to contact a workers’ compensation attorney more specifically.

These are some of the most common reasons to sue an employer. Others include discrimination, sexual harassment at work, retaliatory termination, and defamation.
